Bereavement of a Child - Still Births and Newborn Deaths

No matter how old your baby is, the loss of a child is the most devastating tragedy that will turn your world upside down. Stillbirth can touch the lives of any one of us as17 babies are stillborn or die shortly after birth in the UK every day.

The term stillbirth refers to babies that are born dead after 24 or more weeks. It is not always possible to prevent stillbirth and in many cases the cause will remain unknown.

There are some recognised causes of stillbirth such as genetic abnormalities, where a defect has prevented the baby from developing fully, or problems with the placenta having affected the blood supply to the baby, and in these cases it does not mean that the stillbirth was anyone’s fault.

However, there are still some cases where a mistake by your medical team has caused the death of your baby, and but for that mistake, your baby could be alive today.

If it can be shown that you received substandard care from your general practitioner, midwife or obstetrician during your pregnancy, or after birth, and that this caused the death of your baby then you may be able to make a claim for a bereavement award.

It may be the case that there was a failure or delay by your medical team to diagnose a number of conditions for example an infection, high blood pressure (pre-eclampsia), low blood sugar (hypoglycaemia) or jaundice (hyperbilirubinemia).

Your medical team may have made an incorrect diagnosis and started the wrong treatment or even ignored important signs and symptoms indicating that there was a problem thereby missing a golden opportunity to intervene and prevent the death of your baby. All of this would be classed as substandard care.
